Touching The Woman Does Not Nullify The Wudoo

Some Positions of Jurisprudence of The Eminent Shaykh ‘Abdul-Aziz Ibn Baaz (may Allah have mercy upon him):

The touching of the woman does not nullify the Wudoo. This is whether the touching took place based upon desired or other than desires.

The statement of Allah:

أَوْ لامَسْتُمُ النِّسَاءَ
“Or you have touched them.” (Soorah an-Nisaa: 43)

The intended (meaning) is the sexual relations just as Ibn Abbaas (may Allah be pleased with him) and a group from the people of knowledge have stated. The intent is not touching (the woman) with the hand.


The statement of Allah:

أَوْ جَاءَ أَحَدٌ مِنْكُمْ مِنَ الْغَائِطِ
“…or one of you has come from relieving oneself.” (Soorah an-Nisaa: 43)

This statement points to the lesser occurrence of breaking one’s state of purification. As for his statement, “Or you have touched them”—this points to the major occurrence. That’s because the (phrase) al-Mulaamasah (touching) is a figure of speech regarding sex in the most correct of the two statements of the ‘Ulamaa.

There’s no established proof that indicates that the Wudoo is nullified unrestrictedly by way of touching the woman.

قال سماحة الشيخ عبدالعزيز ابن باز رحمه الله

باب نواقض الوضوء

مس المرأة لا ينقض الوضوء، سواءً كان عن شهوة، أو غير شهوة. 10/133

قوله سبحانه وتعالى: ((أَوْ لامَسْتُمُ النِّسَاءَ)) [النساء: من الآية 43] المراد به الجماع، كما قال ابن عباس وجماعة من أهل العلم، وليس المراد به مس اليد. 10/133

قوله سبحانه وتعالى: ((أَوْ جَاءَ أَحَدٌ مِنْكُمْ مِنَ الْغَائِطِ)) [النساء:43] يشير إلى الحدث الأصغر، وقوله ((أَوْ لامَسْتُمُ النِّسَاءَ)) [النساء:43] يشير به إلى الحدث الأكبر ،

لأن الملامسة كناية عن الجماع في أصح قولي العلماء

ليس هنا حجة قائمة تدل على نقض الوضوء بلمس المرأة مطلقاً. 17/219
